Right to Information Act, 2005

The Government of India has enacted the Right to Information Act, 2005 to enable the citizens of India to secure access to information under the control of public authorities, in order to promote transparency and accountability in the working of every public authority.

What is Information?

According to section, 2 (f) of RTI Act 2005 'information" means any material in any form, including records, documents, memos, e-mails, opinions, advices, press releases, circulars, orders, logbooks, contracts, reports, papers, samples, models, data material held in any electronic form and information relating to any private body which can be accessed by a public authority under any other law for the time being in force.

What is Right to Information?

The Right to Information provides access to information held by or under the control of any public authority and includes the right to inspect work, documents, records; take notes, extracts or certified copies of documents or records; take certified samples of material and obtain information stored in electronic form.

Who can ask for Information?

Any citizen of India who desires to obtain any information can make a request in writing or through electronic means in English or Hindi or in the official language of the area in which the application is being made along with the prescribed fees.

What is the fees to get information?

Application Fee:- An application/ request for information under section 6(1) of RTI Act, 2005 must be accompanied by a fee of Rupees Ten (10). The fees can be paid in cash to NPS Trust against a proper receipt or by way of a demand draft or bankers cheque (payable at New Delhi) in favour of NPS Trust or by way of Indian Postal Order payable to the Accounts Officer of NPS Trust or by electronic means.

Cost of providing information in print or in any electronic format:-

  • Rupees two for each page in A-4 or A-3 or smaller size paper
  • Actual cost or price of a photocopy in large size paper
  • Actual cost or price for samples or models
  • Rupees Fifty per diskette or floppy
  • Price fixed for a publication or rupees two per page of photocopy for extracts from the publication
  • No fee for inspection of records for the first hour of inspection and a fee of rupees five (5) for each subsequent hour or fraction thereof, and
  • So much of postal charge involved in supply of information that exceeds fifty rupees.

Exemption from payment of fees:- No fee shall be charged from any person who is below poverty line provided a copy of the certificate issued by the appropriate Government in this regard is submitted along with the application.

Who will provide the information?

The Central Public Information Officer (CPIO) designated by NPS Trust shall provide the information. The details of the CPIO designated by NPS Trust are as follows:-

How and where to make an application/request for information?

Online:- For making request for information online, please visit the RTI Online portal at https://rtionline.gov.in In the online RTI Request form, select ‘Department of Financial Services’ from the drop down menu available for selecting Ministry/Department/Apex Body. Then select ‘National Pension System Trust’ from the drop down menu available for selecting Public Authority. Thereafter, the person may proceed with filing his/her personal details and the text for RTI request application along with supporting documents, if any and the prescribed application fee.

Offline:- The applicant making the request for information under RTI Act, 2005 can submit the application in writing addressed to the CPIO of NPS Trust accompanied by the prescribed application fee. The applicant to provide his contact details viz., email address, contact number, residential address etc.

Disposal of applications under RTI Act, 2005

The CPIO within 30 days from the receipt of request for information u/s 6 of RTI Act, 2005 will provide the information on payment of requisite application fee.

If providing the information requires additional cost to be paid by the applicant as mentioned in section III (b) above, the CPIO shall intimate the applicant about the additional cost of providing information. The period intervening between the communication of the said intimation to the applicant and payment of such fees/cost by the applicant shall be excluded from the calculation of 30 days referred above in point ‘a’. No additional fee shall be charged from the applicants who are below the poverty line as may be determined by the appropriate Government.

In the event information sought concerns the life or liberty of a person, the same shall be provided by the CPIO within forty-eight hours of the receipt of the request.

In case the information sought from CPIO of NPS Trust is held by another public authority or the information sought is closely connected with the functions of another public authority, the CPIO, NPS Trust shall transfer the application or such part of it as may be appropriate to that public authority within 5 days from the date of receipt of the application and shall inform the applicant about such transfer.

The CPIO may reject the request for information under sections 8 and 9 of the RTI Act, 2005. The information that is exempt from disclosure u/s 8 and 9 of the RTI Act, 2005 is as follows:-

  • Information, disclosure of which would prejudicially affect the sovereignty and integrity of India, the security, strategic, scientific or economic interests of the State, relation with foreign State or lead to incitement of an offence;
  • Information which has been expressly forbidden to be published by any court of law or tribunal or the disclosure of which may constitute contempt of court;
  • Information, the disclosure of which would cause a breach of privilege of Parliament or the State Legislature.
  • Information including commercial confidence, trade secrets or intellectual property, the disclosure of which would harm the competitive position of a third party, unless the competent authority is satisfied that larger public interest warrants the disclosure of such information;
  • Information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information;
  • Information received in confidence from foreign Government;
  • Information, the disclosure of which would endanger the life or physical safety of any person or identify the source of information or assistance given in confidence for law enforcement or security purposes;
  • Information which would impede the process of investigation or apprehension or prosecution of offenders;
  • Cabinet papers including records of deliberations of the Council of Ministers, Secretaries and other officers;
  • Information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual.
  • Information, providing access of which would involve an infringement of copyright subsisting in a person other than the State.

Besides above, in the event information sought is a third party information, the CPIO may seek permission from the third party for such disclosure.

What is the remedy available to the applicant if he/she is not satisfied with the response of the CPIO?

Any person who is aggrieved by the response of the CPIO may within 30 days from the receipt of the response of the CPIO prefer an appeal to the First Appellate Authority at NPS Trust. The details of the First Appellate Authority are as follows:-

In the event, the applicant is not satisfied with the response of the First Appellate Authority as well, the applicant may prefer an appeal to the Chief Information Commissioner appointed in terms of Chapter III of the RTI Act, 2005.

National Pension System Trust (NPS Trust) was established under the provisions of The Indian Trusts Act, 1882, vide Trust Deed dated 27-February-2008 executed by the Pension Fund Regulatory and Development Authority (PFRDA). NPS Trust holds the assets of the subscribers for their benefit. NPS Trust is responsible for monitoring and evaluation of all operational and service level activities of Pension Fund, Custodian, Trustee Bank and Central Recordkeeping agencies with respect to exits & withdrawals. NPS Trust performs its functions in accordance with the provisions of Trust Deed and the PFRDA (National Pension System Trust) Regulations, 2015. The said Regulations and amendments thereto are available on the website of NPS Trust.
Powers & Duties of the officers and employees of NPS Trust
NPS Trust is managed by a Board of Trustees appointed by the PFRDA from time to time. One of the Trustees appointed is designated as Chairperson of the Board of Trustees of NPS Trust by PFRDA. PFRDA also appoints a Chief Executive Officer of NPS Trust, who shall not be a Trustee of such Trust. The Chief Executive Officer is responsible for day-to-day administration and management of NPS Trust. The powers, functions and duties of NPS Trust are laid down in the PFRDA (National Pension System Trust) Regulations, 2015 besides the provisions of the Trust Deed dated 27-February-2008.
Procedure followed in the decision making process, including channels of supervision and accountability
The Chief Executive Officer is responsible for day-to-day administration and management of NPS Trust, subject to the superintendence, direction and control of the Board of Trustees of NPS Trust. The CEO is aided and assisted by the staff of the NPS Trust in discharging the affairs of the Trust and is guided by the Board of Trustees in discharge of his functions.

The Chief Executive Officer and the staff of NPS Trust exercise such powers as have been delegated by the Board of Trustees for the effective discharge of responsibilities and in achieving the objectives of NPS Trust.
Norms set for discharge of functions
NPS Trust performs its functions in accordance with the provisions of Trust Deed and the PFRDA (National Pension System Trust) Regulations, 2015. The said Regulations and amendments thereto are available on the website of NPS Trust.

NPS Trust is responsible for monitoring and evaluation of all operational and service level activities of Pension Fund, Custodian, Trustee Bank and Central Recordkeeping agencies with respect to exits & withdrawals. PFRDA, the Regulator has laid down Regulations for each of the aforesaid intermediary under the NPS architecture and rules, circulars, guidelines etc., issued thereunder. Besides the provisions of Trust Deed and the PFRDA (National Pension System Trust) Regulations, 2015, NPS Trust also performs its monitoring activities in accordance with the Regulations laid down by PFRDA for the said intermediaries.
